General Terms & Conditions — Brokerage Services
These terms form part of the brokerage agreement and are printed on the reverse side of the contract.
Part I — Classic Car Fundamentals
1. Definition
A classic car is a historically significant motor vehicle of at least 30 years of age, traded on the basis of its age, rarity, originality and character — not by the standards of modern production vehicles.
2. No Manufacturer Warranty
All vehicles are used and sold as-is without manufacturer warranty, unless expressly stated otherwise in the individual listing.
3. Seller's Terms
The seller's terms and conditions are binding for each transaction. JPE Classic Cars & Brokerage acts exclusively as an intermediary.
Important Notice — Vehicles from the USA and Canada: Vehicles from the United States or Canada are generally sold on an AS IS basis. The buyer assumes full responsibility for the vehicle's condition at the time of purchase. No claims may be made against the seller or JPE Classic Cars & Brokerage after the transaction is completed.
4. Wear, Patina & Age-Related Condition
Classic cars carry age-related signs of use — including surface rust, paint damage, wear to interior components, repaired or modified parts, and electrical systems. This does not constitute a defect.
5. Condition at Time of Inspection
The vehicle condition documented in the inspection report is binding. Changes occurring after the inspection date are outside the responsibility of JPE Classic Cars & Brokerage.
6. No Guarantee of Road Approval
Unless expressly confirmed in the listing, JPE Classic Cars & Brokerage does not guarantee that a vehicle is road-registered, MOT-approved, or immediately roadworthy in the buyer's country of registration.
7. Import, Tax & Registration Costs
The buyer bears sole responsibility for import duties, customs fees, VAT, local taxes and registration costs in their country.
8. Historic Registration / H-Plate
Vehicles over 30 years old may qualify for historic registration. JPE Classic Cars & Brokerage advises on eligibility but cannot guarantee approval. Registration support is available exclusively for Germany, Austria and Switzerland.
Part II — Brokerage Services & Process
9. Mandatory Vehicle Inspection
A professional pre-purchase inspection is mandatory for every vehicle we broker — without exception. If a buyer refuses, JPE Classic Cars & Brokerage reserves the right to immediately terminate all negotiations.
- Mechanical condition (engine, gearbox, brakes, suspension)
- Body and frame integrity (rust, accident damage, repairs)
- Electrical systems
- Interior condition
- Document and title verification
- VIN / chassis number authenticity check
- Comprehensive photography and test drive
10. Buyer's Right to Personal Inspection
The buyer has the right to inspect the vehicle in person at any time. If a JPE representative conducts an on-site inspection, the buyer bears travel and accommodation costs plus an inspection fee of €450.00 (excl. VAT) — non-refundable.
11. Vehicle Handover & Transfer of Risk
Official handover occurs upon arrival at the port of entry, confirmed by written notification from the appointed freight forwarder. From this point, the vehicle is the full responsibility of the buyer.
12. Vehicle Transport
JPE Classic Cars & Brokerage arranges access to a trusted German freight forwarder with over 15 years of cooperation. The buyer is the direct contractual partner. JPE Classic Cars & Brokerage accepts no liability for transport-related damage or delays.
13. Escrow Payment
Upon request, purchase price payments may be processed via escrow through our law firms in Germany and the USA. The buyer bears all associated costs.
Part III — Vehicle Search
14. Search Order & Contract Conclusion
A vehicle search order is deemed agreed once both parties have signed the brokerage agreement. Submitting the search form on our website does not constitute a brokerage agreement.
15. Scope of Vehicle Search
Each search order covers a maximum of 5 vehicles. If further offers are required after viewing 5 vehicles without a purchase decision, a new search order with a new fee is required.
16. Search Fee
- €500.00 (excl. VAT) — non-refundable advance payment
- Due within 3 days of contract conclusion
- 100% credited against the brokerage commission upon successful placement
17. Broker's Obligations
JPE Classic Cars & Brokerage undertakes to present up to 5 suitable vehicles, verify all documents, and forward purchase documentation to the contracting parties.
Part IV — Commission & Payment
18. Brokerage Commission
Commission: 4.0% of the purchase price (excl. VAT) — Minimum: €1,200.00 (excl. VAT)
1st instalment (50%) — due upon collection from seller (confirmed by freight forwarder)
2nd instalment (50%) — due upon arrival at port of entry (confirmed by freight forwarder)
19. Fee Offsetting
- Vehicle search fee → 100% credited against commission upon purchase
- Inspection costs → invoiced separately
20. Cash Payments
Cash payments are strictly prohibited. All payments exclusively by bank transfer or via the escrow service.
21. Vehicle Release
A vehicle will only be released after full payment of the brokerage commission. Storage costs from delayed payment are borne exclusively by the buyer.
Part V — General Provisions
22. Special Agreements
Special agreements require written form. Verbal agreements are not legally binding.
24. Buyer Confirmation
By signing the brokerage agreement or submitting the vehicle search form, the buyer confirms having fully read, understood and accepted these Terms & Conditions.

Diese Bedingungen sind Bestandteil des Vermittlervertrages und werden auf der Rückseite des Vertrages abgedruckt.
Teil I — Grundlagen zum Oldtimer
1. Definition
Ein Oldtimer ist ein historisch bedeutsames Kraftfahrzeug mit einem Mindestalter von 30 Jahren, das aufgrund seines Alters, seiner Seltenheit, Originalität und seines Charakters gehandelt wird — nicht nach den Standards moderner Serienfahrzeuge.
2. Keine Herstellergarantie
Alle Fahrzeuge sind Gebrauchtfahrzeuge und werden ohne Herstellergarantie im jeweiligen Zustand verkauft, sofern in der Einzelanzeige nicht ausdrücklich anders angegeben.
3. Bedingungen des Verkäufers
Die Verkaufsbedingungen des jeweiligen Verkäufers sind für jede Transaktion bindend. JPE Classic Cars & Brokerage handelt ausschließlich als Vermittler.
Wichtiger Hinweis — Fahrzeuge aus den USA und Kanada: Fahrzeuge aus den Vereinigten Staaten oder Kanada werden in der Regel unter dem Grundsatz AS IS (Kauf wie gesehen) verkauft. Der Käufer übernimmt die volle Verantwortung für den Fahrzeugzustand zum Zeitpunkt des Kaufes. Nach Abschluss der Transaktion können keinerlei Ansprüche geltend gemacht werden.
4. Verschleiß, Patina & altersbedingter Zustand
Oldtimer tragen altersbedingte Gebrauchsspuren — Dies können unter anderem Oberflächenrost, Lackschäden, Verschleiß an Innenausstattung, reparierten oder modifizierten Bauteilen sowie elektrischen Systemen sein. Dies stellt keinen Mangel dar.
5. Zustand zum Zeitpunkt der Inspektion
Der im Inspektionsbericht dokumentierte Fahrzeugzustand ist verbindlich. Zustandsveränderungen nach dem Inspektionsdatum liegen außerhalb der Verantwortung von JPE Classic Cars & Brokerage.
6. Keine Garantie der Straßenzulassung
Sofern in der Anzeige nicht ausdrücklich bestätigt, übernimmt JPE Classic Cars & Brokerage keine Gewähr dafür, dass ein Fahrzeug straßenzugelassen, TÜV-geprüft oder im Zulassungsland des Käufers unmittelbar fahrbereit ist.
7. Einfuhr-, Steuer- und Zulassungskosten
Der Käufer trägt allein die Verantwortung für Einfuhrzölle, Zollgebühren, Mehrwertsteuer, lokale Steuerabgaben sowie Zulassungskosten in seinem Land.
8. Historische Zulassung / H-Kennzeichen
Fahrzeuge mit einem Alter von über 30 Jahren können für eine historische Zulassung in Frage kommen. JPE Classic Cars & Brokerage berät zur Anspruchsberechtigung, kann jedoch keine Genehmigung garantieren. Die Unterstützung ist ausschließlich für Deutschland, Österreich und die Schweiz verfügbar.
Teil II — Vermittlungsleistungen & Ablauf
9. Obligatorische Fahrzeuginspektion
Eine professionelle Fahrzeuginspektion vor dem Kauf ist obligatorisch — ohne Ausnahme. Lehnt ein Käufer die Inspektion ab, behält sich JPE Classic Cars & Brokerage das Recht vor, alle Verhandlungen sofort zu beenden.
- Mechanischer Zustand (Motor, Getriebe, Bremsen, Fahrwerk)
- Karosserie und Rahmenintegrität (Rost, Unfallschäden, Reparaturen)
- Elektrische Systeme
- Innenausstattung
- Dokumenten- und Titelprüfung
- Authentizitätsprüfung von Fahrgestellnummer / VIN
- Ausführliches Bildmaterial sowie Testfahrt
10. Recht des Käufers auf persönliche Besichtigung
Der Käufer hat jederzeit das Recht, das Fahrzeug persönlich zu besichtigen. Inspektionsgebühr bei JPE-Vertreter vor Ort: €450,00 (zzgl. MwSt.) — nicht erstattungsfähig.
11. Fahrzeugübergabe & Gefahrenübergang
Die offizielle Übergabe erfolgt mit der Ankunft im Eingangshafen, bestätigt durch die schriftliche Mitteilung der Spedition. Ab diesem Zeitpunkt liegt das Fahrzeug in der vollen Verantwortung des Käufers.
12. Fahrzeugtransport
JPE Classic Cars & Brokerage vermittelt den Zugang zu einer bewährten deutschen Spedition. Der Käufer ist direkter Vertragspartner. JPE Classic Cars & Brokerage übernimmt keine Haftung für transportbedingte Schäden oder Verzögerungen.
13. Treuhandzahlung
Auf Wunsch kann die Kaufpreiszahlung über eine treuhänderische Abwicklung erfolgen. Der Käufer trägt alle damit verbundenen Kosten.
Teil III — Fahrzeugsuche
14. Suchauftrag & Vertragsabschluss
Ein Fahrzeugsuchauftrag gilt als vereinbart, sobald beide Parteien den Vermittlervertrag unterzeichnet haben. Durch die Absendung des Suchformulars entsteht noch kein Vermittlervertrag.
15. Umfang der Fahrzeugsuche
Each search request includes a maximum of 5 vehicles. If the buyer requires further offers without making a purchase decision, a new search request is required.
16. Search Fee
- €500.00 (plus VAT) — non-refundable prepayment
- Due within 3 days after contract conclusion
- Will be 100% offset against the commission upon successful brokerage
17. Obligations of the Broker
JPE Classic Cars & Brokerage commits to presenting up to 5 suitable vehicles, verifying all documents, and forwarding the paperwork.
Part IV — Commission & Payment
18. Broker's Commission
Commission: 4.0% of the purchase price (plus VAT) — Minimum commission: €1,200.00 (plus VAT)
1st installment (50%) — due upon collection from the seller
2nd installment (50%) — due upon arrival at the port of entry
19. Fee Offset
- Vehicle search fee → 100% offset against commission upon purchase
- Inspection costs → will be charged separately
20. Cash Payments
Cash payments are strictly prohibited. All payments exclusively via bank transfer or escrow service.
21. Vehicle Release
A vehicle will only be released after full payment of the commission. Storage costs due to delayed payment shall be borne exclusively by the buyer.
Part V — General Provisions
22. Special Agreements
